Appeal from a judgment of the County Court of Broome County (Daley, J.), rendered November 19, 2007, upon a verdict convicting defendant of the crime of assault in the second degree.

Defendant was convicted of assault in the second degree for assaulting a 42-year-old woman (hereinafter the victim) whose sister was engaged in a custody battle with defendant. On August 18, 2005, custody was awarded to the victim’s sister and that afternoon defendant encountered the victim, who was walking on a street in defendant’s neighborhood in the City of Binghamton, Broome County.
