I. INTRODUCTION

Pursuant to a plea and cooperation agreement, Brandon Bradbury pleaded guilty in 1995 to a kidnapping conspiracy *202charge involving 378 pounds of marijuana. After he was later indicted on different charges, he pleaded guilty to a firearm charge under a second plea agreement in 1998. The United States District Court for the Northern District of New York (Frederick J. Scullin, Jr., Judge) sentenced Bradbury on both charges.
