Appeal from a judgment entered on April 4, 2002 in the United States District Court for the Northern District of New York, Scullin, C.J. The defendant pled guilty to one count of possession with intent to distribute a mixture and substance containing a detectable amount of cocaine base in violation of 21 U.S.C. §§ 841(a)(1) and 841(b)(1)(C) and was sentenced principally to 140 months imprisonment.
