The International Union, Allied Industrial Workers of America, AFL-CIO (“the International”) and Local 803, Allied Industrial Workers of America, AFL-CIO (“the Local”) appeal from a judgment entered against them following a non-jury trial. The district court found that the International and the Local breached their duty of fair representation in connection with the layoff of Marcus Galindo by the Stoody Company (“Stoody”).
