VOGEL, District Judge.

This is a civil action brought by the Administrator of the Office of Price Administration against the defendant, the operator of a garage and sales agency, under the provisions of the Emergency Price Control Act of 1942, and amendments thereof, 50 U.S.C.A.Appendix, § 925(e).

It was the contention of the plaintiff that the defendant sold nine used trucks for amounts exceeding the ceiling price thereon and, accordingly, suit was brought' to recover three times the amount of such overcharges. Upon demand by the defendant, the case was tried to a jury, which returned a…
