This case comes before the court on the parties’ requests for review by the court of the recommended decision, filed March 23,1973, by Trial Judge Hal D. Cooper pursuant to Rules 166(c) and 54(b). The court has considered the case on the ’briefs and oral argument of counsel.

On the issue of the loading-charge refund, the court stresses, perhaps somewhat more than the trial judge did in his opinion, that the plaintiff should have been aware, from the time he received the invitation for bids for the contract in suit, that at the best (from his viewpoint) there was a very serious question whether…
