The appellant contends that an appeal to the Court of Common Pleas under R. C. Chapter 2506 may not be disposed of by summary judgment under Civ; R. 56. Appellant initially attempted to appeal the denial of a permanent appointment as a fireman to the Athens civil service commission under R. C. 143.27 which had been repealed and recodified as R.
