Plaintiff instituted this action to recover compensation for personal injuries sustained by him when he was struck by a Seattle street car. The charges of negligence on the part of the motorman who was in charge of the operation of the street car at the time of the injury, are that he was operating the car without watching for traffic in the front thereof and at a dangerous and excessive rate of speed, in excess of thirty-five miles per hour; that the front lights of the street car were out; that he failed and neglected to apply the brakes or to sound any warning when he saw or should have…
