Plaintiff filed this bill for specific performance of an agreement relating to a tract of land of between 16 and 17 acres in the township of Buena Vista, Saginaw county, located near the city of Saginaw. Early in 1919 plaintiff learned from a sister of defendant that he owned the property and it was for sale. He thereafter interviewed defendant upon the subject who replied he owned the property and it was for sale at $3,500.
