This is an appeal from an order of tbe circuit court denying defendant’s (appellant’s) motion to set aside a default decree. Subsequent to tbe determination of tbe matter in tbe lower court botb parties bave died and appropriate orders of substitution entered herein.
Tbe facts are simple. Plaintiff was the vendor and defendant the vendee in a contract for the sale of real property in Columbia county.
