OPINION
MARGOLIS, Judge.
This patent case comes before the court on remand from the United States Court of Appeals for the Federal Circuit. Plaintiffs, Gargoyles, Inc. (“Gargoyles”) and Pro-tec, Inc. (“Pro-tec”), brought suit in this court pursuant to 28 U.S.C. § 1498(a),1 seeking damages for the infringement of a design patent and a utility patent. After a five-day trial, this court found that defendant, acting through the United States Army (“Army”), had not infringed plaintiffs’ patents.
