FRIENDLY, Circuit Judge:

This expedited appeal from an order of the District Court for the Northern District of New York entered on February 16,1979,1 raises questions of the power and propriety of a district court’s granting an American manufacturer relief ancillary to the primary relief sought by it in an action in the Customs Court under 19 U.S.C. § 1516 protesting the failure of the Secretary of the Treasury to impose antidumping duties under 19 U.S.C. § 160. Being in basic agreement with Judge Foley’s well reasoned opinion which refused to grant such relief, we affirm his order dismissing…
