VAN DEVANTER, Circuit judge.
The facts necessary to an understanding of the controversy presented in this case are these: At her death Jane C. Brown, of Arapahoe county, Colo., was the owner in fee of a large amount of real property in that and other counties, all of which by her will was devised to her husband, Henry C. Brown, part in fee and part for the term of his life with a power to appoint those who should take the estate in remainder. The will also named him as executor.
