ON THE MERITS

OPINION

On the 14th day of October 1942 George A. Montrose, administrator of the estate of Harry F. Powell, sometimes known as H.F. Powell, deceased, filed a petition in the district court of Lyon County, Nevada, praying for an order of sale of real and personal property. The said petition, insofar as it is material here, is as follows:
