On the 14th day of October 1942 George A. Montrose, administrator of the estate of Harry F. Powell, sometimes known as H. F. Powell, deceased, filed a petition *123in the district court of Lyon County, Nevada, praying for an order of sale of real and personal property. The said petition, insofar as it is material here, is as follows :

“That the assets in said estate consists of real and personal property in Lyon County, Nevada, as hereinafter described. That the principal asset is what is known as the New Jerusalem ranch near Dayton, Nevada, which ranch is irrigated…
