GRAY, Circuit Judge.

Judgment was entered against the plaintiff in error, as defendant in the court below (and hereinafter called the defendant), at the suit of the defendant in error (hereinafter called the plaintiff), on a contract of suretyship, and to this judgment a writ of error was sued out by the defendant. The status of the case in the court below is thus stated by the learned trial judge, in the opening paragraphs of his opinion (166 Fed. 356):.“At the close of the trial in this case, it was agreed by the parties that no Questions called for submission to the jury.
