The nature of this controversy appears in the opinion delivered by Judge Holland in the circuit court, which is reported in 172 Fed., at page 269. Little need be added to his satisfactory discussion of the questions involved, and we shall there*693fore content ourselves with noticing briefly the argument of the plaintiff in error.
