This case arose out of the same state of facts as those that have been recited in the case of this plaintiff in error against George Baglin (No. 55, October Term) 178 Fed. 682, ".nd it has been agreed between counsel that the facts set forth in the record of that case, so far as they are relevant, will be considered as part of the record in this case.
