This matter is before the court on two motions for partial summary judgment filed by plaintiff Burroughs Wellcome Co. (“BW Co.”). BW Co. moves for partial summary judgment against defendants Barr Laboratories, Inc., (“Barr”), and Novopharm, Inc., and Novopharm Ltd. (together “Novopharm”) that no employee of the National Institutes of Health (“the NIH”) was an inventor of any of the subject matter claimed in U.S. patents 4,724,232 (the “’232 patent”) and 4,833,130 (the “ 130 patent”).
