{¶ 1} In this appeal from the Wood County Court of Common Pleas, we are asked to determine whether the trial court erred in dismissing appellant’s complaint for lack of subject-matter jurisdiction.

{¶ 2} On October 12, 2005, appellant, Larry R. Dargart, filed a complaint in the common pleas court asserting a claim against appellee, the Ohio Department of Transportation (“ODOT”) under R.C. 4113.52, the Ohio Whistleblower Statute.
