Introduction

In this chapter 11 case, Principal Mutual Life Insurance Company (“Principal”) filed a motion for relief from stay for the purpose of foreclosing its deed of trust against the debtor’s principal asset, an office building. The debtor objected to the relief from stay motion and filed its own motion for authority to use the building rents as cash collateral pursuant to 11 U.S.C. § 363(c)(2). Prior to commencement of debtor’s chapter 11 case, Principal had exercised its rights under the deed of trust and a collateral assignment…
