This was an action for damages for breach of contract, and upon an indemnifying bond given to secure the performance thereof, commenced by the defendant in error, plaintiff below, against the plaintiffs in error, defendants below. Upon issue being joined the cause was tried to a jury. After the evidence was all in, the court instructed the jury to return a verdict in favor of the plaintiff and against all the defendants for the sum of $5,259.30. Upon the verdict being returned by the jury, pursuant to the instructions of the court, judgment was entered thereon, to reverse which this…
