Error from District Court, Jefferson County; Cham Jones, Judge. Action by the North Healdton Oil & Gas Company against W. G. Skelley and another, doing business under the firm name of the Skelley Drilling Company. Erom a judgment sustaining a demurrer to the petition, plaintiff appeals.

The petition in this cause alleges that the plaintiff is a corporation engaged, among other things, in the oil and gas mining business, and that it is the owner of an oil and gas lease covering a tract of land in Jefferson county; that said tract of land is located in the North Healdton oil and gas field, which was and is a tried and developed oil and gas field, containing many successfully operated and productive oil and gas wells in close proximity to and surrounding the property of the plaintiff; that in order to develop the said tract of land the plaintiff entered…
