Before the Court is defendant Eli Lilly and Company’s (“Eli Lilly”) Motion for Summary Judgment (“Defs.’ Mot.”), joined by defendants Bristol-Myers Squibb Company (“Bristol-Myers”), Dart Industries, Inc. (“Dart”), GlaxoSmithKline, Inc. (“GSK”), and Premo Pharmaceutical Laboratories, Inc. (“Premo”) (collectively “defendants”).
