Defendant appeals a conviction, following a trial to the court, for driving while under the influence of intoxicants (DUII). ORS 813.010. Defendant assigns error to (1) the trial court’s denial of his motion in limine to exclude evidence of his marijuana consumption and its effects and (2) the court’s denial of his motion for a judgment of acquittal on the ground that there was insufficient evidence that he operated his vehicle under the influence of a controlled substance.
