THE COURT.

This appeal is from a judgment for five thousand dollars damages, entered upon a verdict for plaintiff in an action for personal injuries sustained by plaintiff while riding as a guest in defendant’s automobile. Defendant admits that he was negligently operating the automobile at the time of the accident, and that his negligence was a proximate cause of the injuries of which complaint is made, but defends upon the ground that plaintiff was guilty of contributory negligence and that such contributory negligence was a proximate cause of her injuries.
