This appeal arose from a patent infringement suit brought by Chiuminatta Concrete Concepts, Inc., Edward Chiumi-natta, and Alan R. Chiuminatta (collectively, “Chiuminatta”) against Cardinal Industries, Inc. (“Cardinal”) and Green Machine Corporation (“GMC”). Chiuminatta sued the defendants in the Central District of California for infringement of several patents, including U.S. Patent No. 4,889,675 (“the ’675 patent”) and U.S. Patent No. 5,056,499 (“the ’499 patent”).
