This appeal is from the action of the lower court in granting plaintiff’s motion for judgment n. o. v. The facts (agreed upon by counsel for both parties as per agreement filed) are as follows: Plaintiff brought suit against the defendant upon a written guaranty or suretyship dated May 24, 1928, signed by the defendant, who, prior to that date, was president of the Intercity Oil Company, a corporation engaged in the sale of gasoline, oil, and petroleum products.
