Action was brought in the district court of Creek county, Okla., by plaintiffs in error for the recovery of certain lands situated in said county and to quiet title to the same. There is .but one question to be determined in this case. In the trial court the defendants in error, who were defendants in such court, filed the following motion to dismiss:
