This action was commenced in the district court of Sequoyah county March 11, 1931, and on the 3rd day of January, 1983, a judgment was rendered for the defendant Francis M. Clark, for the possession of the premises involved in the action. A petition in error with case-made attached was filed July 27, 1933, and on August 12, 1933, a motion to dismiss was filed by the defendant Francis M. Clark.
