Petitioner Kent Gambee seeks judicial review of a final order on reconsideration of the Board of Forestry (board). In that order, the board determined that Gambee, who is a landowner and lumber broker, had conducted a timber harvest operation within the meaning of the Oregon Forest Practices Act, ORS 527.610 to 527.770, ORS 527.990(1), and ORS 527.992, and that he was liable for violations of administrative rules pertaining to the retention and protection, during timber harvest operations, of bald eagle nesting sites.
