The defendant bank, a corporation under the laws of this state, at all the times involved down to January 25, 1924, was engaged in a general banking business at Missoula. On the date above mentioned, being in an insolvent condition, it closed its doors and ceased transacting business. Thereafter the defendant Dick was duly appointed receiver of the bank, qualified, and has at all times since been acting as such, having complete possession and control of all its assets and business affairs.
