This is an action in equity brought by the plaintiff against the Sheridan County State Bank, John W. Shelby and T. L. Beiseker as defendants, for an accounting and in an endeavor to have a resulting trust declared as to certain real estate, title to which is vested in the Sheridan County State Bank. The defendant answered the plaintiff’s complaint, admitting and denying certain allegations thereof and alleging new matter by way of affirmative defense.
