No claim or pleading was filed in the court below, and the rights of the parties are to be determined on the agreed case under section 553, R. S. 1881.

Omitting the formal parts, the agreement is as follows:

"It is agreed that Charity Middleton, the decedent, made and executed her last will, which has been duly admit*487ted to probate in the Randolph Circuit Court, a copy of which * * * is filed and made a part of this agreement; that said will was made on the 3d of October, 1874; that afterwards, to wit, on the 27th of February, 1887, the said Charity Middleton made a codicil to her said will,…
