MEMORANDUM OPINION AND ORDER

ALBRITTON, Chief Judge.

I. INTRODUCTION

This cause is before the court on a Mo-; tion to Dismiss the Claims of Bobbie L. Stanfill, filed by Defendant United States of America on January 13, 1999. 1 Mr. Stanfill alleges that he received negligent medical care at the Lyster Army Community Hospital in Fort Rucker, Alabama, which caused permanent injury to his right eye.
