On March 13, 1963, petitioner, a resident of Kentucky, began an action under the Federal Employers’ Liability Act, 35 Stat. 65, as amended, 45 U. S. C. § 51 et seg. (1958 ed.), in the Common Pleas Court of Hamilton County, Ohio. He alleged that he had been injured on March 17, 1960, in Indiana, while in. the course of his employment with respondent, the New York Central Railroad.
