Duckworth, Justice.

In ground 1 of the amendment to the motion for a new trial complaint is made because the court failed to charge the jury on the contentions of the defendant, or refer to them, to wit: (a) that he did not commit the crime with which he was charged; (b) that he was not present at the place of the offense at the time it was committed; and (c) that the offense was committed by another person.
