EVA M. GUZMAN, Justice.

Thomas Retzlaff, a prisoner in the Texas Department of Criminal Justice, appeals the summary dismissal of his tort claim and petition for judicial review. We affirm in part and reverse and remand in part.

Background

Appellant is an inmate housed in the Texas Department of Criminal Justice (TDCJ). On or about May 4, 2000, appellant was issued a new pair of work boots. Shortly thereafter, appellant claims he notified the boot room attendant of a defect in the stitching of one of the boots.
