*835This is the second appeal of this case. The opinion on the former appeal may be found in 120 S. W. 361, 131 Ky. 424.
Upon the institution of the action in the court below process was served upon appellant’s advertising and distributing agent. A. motion was made to quash the process, on the ground that service upon such agent was improper. This motion the trial court overruled.
