On October 19, 1923, Wicker filed his original petition in the district court of Lubbock county, alleging, in substance, that on August 1, 1920, the defendant Smith executed and delivered to him a promissory note for $1,250 which was secured by a chattel mortgage on certain crops sold by plaintiff to Smith; that on August 18, 1920, plaintiff executed and delivered to A. E.
