Bell, Justice.

The exception is to a judgment granting a mandamus absolute, requiring the treasurer of Fulton County to pay to the plaintiff, as executrix, a stated sum as a balance of salary alleged to have been due to the testator as assistant probation officer, at the time of his death. The case was submitted on the-pleadings and an agreed statement to Judge A. L. Etheridge, of' the superior court, who delivered the following opinion:
