Marion N. House, while on his way from Tulelake, California, to Portland, Oregon, to attend a zone meeting of Chevrolet dealers and salesmen, was fatally injured near Bend, Oregon, in an accident involving the automobile in which he was riding as a passenger. He left surviving him his widow, the plaintiff herein, and their minor daughter, aged six years. The widow presented to the Oregon state industrial accident commission a claim for compensation for her husband’s death, and upon the commission’s denial thereof this action was instituted.
