Statement of the Case
On May 29, 1935, appellant executed to appellee a lease covering the No. 9 vein of coal, and such coal as may lie beneath No. 9 vein, under 1033.95 acres of coal lands in Ohio County for a period of five years with the option to the lessee, by giving notice as specified in the contract, to extend the lease for an additional five years. By the terms of the lease appellee was to pay appellant live cents per ton royalty on all coal mined and removed from the property during the term of the lease or any extension thereof. Under…
