In the oral argument of this case counsel for the defendant in error made two objections to the record. One of them is that this court is without jurisdiction to consider the assignments of error because it appears that the bill of exceptions was signed after the expiration of the term in which judgment was entered; the other is that the bill is fatally defective because it contains such fragmentary excerpts from the testimony and charge that their relation to the issues in the case cannot be ascertained.
