The defendant, with Paul Higgins, the plaintiff's intestate, left Rock Island, P.Q., for Newport, Vt., about ten o'clock on the night of October 12, 1926, in a Buick touring car which the defendant was driving. The foot brake on this car had given out, as they both knew, but the emergency brake was working. The car was going fast, but just how fast, as we shall see, was left uncertain by the evidence.
