COFFEY, Circuit Judge.

This is an appeal from the Merit Systems Protection Board’s order denying the petitioner’s request for attorney’s fees under 5 U.S.C. § 7701(g). The Merit Systems Protection Board found that they had the authority to award attorney’s fees to the petitioner under 5 U.S.C. § 7701(g), but that an award of attorney’s fees was not warranted in this case.
