The People of the State of California appeal from the trial court’s order modifying the sentence of respondent Richard J. Laue, aka Matheson (hereafter defendant), following resentencing conducted pursuant to Penal Code section 1170, subdivision (d). Defendant had been sentenced to five years in state prison following a plea of guilty. The modification reduced the sentence to four years.
