GREENE, Judge.

Defendant appeals from a judgment entered 12 June 1991, which judgment was based on a jury verdict convicting defendant of one count of manufacturing marijuana, N.C.G.S. § 90-95(a)(l) (1990).

The State’s evidence tended to establish the following: On 28 June 1990, Detective Tom Evans (Detective Evans) of the For-syth County Sheriff’s Department, while a passenger in a State Bureau of Investigation (SBI) aircraft, observed marijuana growing in a wooded area off the runway of Smith-Reynolds Airport.
