The defendant was indicted by the grand jury of the circuit court of the first circuit on August 27, 1917, for the crime of murder in the first degree. The indictment charged the defendant with the killing of one Eustakuia Elj ano on the 13th day of August, 1917, in the City and County of Honolulu, Territory of Hawaii. The defendant was tried before the circuit court of the first judicial circuit, Territory of Hawaii, in September 1917 and was convicted by a jury of murder in the first degree, which in this jurisdiction carries with it the death penalty.
