The defendant was informed against in the superior court of Monterey County for the murder of Henry R. Parley. His motion for a change of place of trial having been denied, he was tried in Monterey County, convicted of murder in the'first degree, and sentenced to death. This court held on an appeal that the motion for a change of place of trial should have been granted, and reversed the judgment, with direction to the superior court of Monterey County to grant said motion.
